Abstract

This research aims to examine the practice of artificial insemination with sperm donors in Indonesia. This research uses normative legal research. The approach used in this research is a statutory approach and a conceptual approach. The results of this research show the importance of legal regulations regarding sanctions for artificial insemination with sperm donors in Indonesia. The act of artificial insemination with a sperm donor is not yet regulated in statutory regulations. In the health law, only the act of artificial insemination in general is regulated, the regulations related to artificial insemination are contained in Article 58 paragraph (1) of Law Number 17 of 2023 concerning Health, in this article it is said that assisted reproduction (insemination artificial) can be done by using the results of fertilization of sperm and ovum from the husband and wife concerned and then implanting it in the wife's womb where the ovum comes from. Artificial insemination is also regulated in Article 1 paragraph (1) of Minister of Health Regulation Number 43 of 2015 concerning the Implementation of Assisted Reproduction Services or Pregnancy Outside of Natural Methods which states that artificial insemination is an act of artificial reproduction by bringing together the husband's spermatozoa with the wife's egg cells in a tube. or implant it into the ovum. In the laws and regulations mentioned above, it is clearly stated that artificial insemination must be carried out using sperm and egg cells from a legal married couple. In the practice of artificial insemination with a sperm donor, the sperm that will be used is sperm from a donor at a sperm bank, so that the sperm cells that will be involved in artificial insemination are not sperm cells from the husband's side, so the act of artificial insemination with a sperm donor will be contrary to statutory regulations. existing invitations. However, regarding this matter, there are no regulations that specifically regulate this action. Therefore, it is important to establish clear regulations regarding sanctions for artificial insemination with sperm donors in order to maintain morality and virtuous traits based on Pancasila for all Indonesian people.
