Abstract

Penelitian ini bertujuan untuk mengetahui mengenai pertanggungjawaban pidana ibu yang mengalami baby blues syndrome yang melakukan tindak pidana serta untuk mengetahui pengaturan baby blues syndrome dalam hukum positif di Indonesia. Metode penelitian ini yaitu pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan Komparatif. Sementara bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer dan sekunder. Pertanggungjawaban pidana bagi ibu yang mengalami baby blues syndrome tidak dijelaskan secara detail yang mengancam keberlangsungan hidup sang anak dalam Kitab Undang-Undang Hukum Pidana pada Pasal 44 ayat (1) KUHP dan pada Pasal 38 Undang-Undang No.1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (selanjutnya disebut KUHP Nasional) juga tidak dijelaskan bagaimana pertanggungjawaban pidana terhadap ibu yang mengalami baby blues syndrome yang melakukan tindak pidana. Hasil dari penelitian ini diharapkan setiap orang atau anak koran yang mengalami tindak pidana oleh ibu yang mengalami baby blues syndrome yang memperoleh keadilan yang haknya sebagai mestinya.
