Abstract
The responsibility of a former husband towards his ex-wife and children after a divorce decree issued by the Religious Court, if stipulated in the petition and approved by the Religious Court, must be carried out by the husband. However, if the husband's obligations after the divorce are not mentioned in the petition, it means that once the divorce decree is issued by the panel of judges, the former husband is no longer required to provide anything to his ex-wife and children. For the husband's obligations that are stated in the petition and agreed upon by the ex-husband, the Religious Court's decision must be implemented as best as possible. However, in practice, the provision of maintenance for the ex-wife and educational expenses for the children typically only lasts for a while, and it will completely stop if the ex-husband remarries. The purpose of this study is to understand and analyze the legal protection of the wife regarding the husband's obligation to provide iddah maintenance and mut'ah maintenance after a divorce decree (talak). This study uses the Legislative Approach, Conceptual Approach, and Case Approach. The research findings indicate that the legal protection for the wife is impacted when the divorce decree issued by the Religious Court panel of judges is not implemented, as well as the legal efforts that must be taken if the husband is unable to fulfill the Religious Court's decision due to financial difficulties, which result in the inability to meet the maintenance demands for iddah, mut'ah, and hadhanah. The benefits of this research are to provide legal certainty and fairness concerning the rights and obligations of both husband and wife after a divorce decree (talak), thus serving as a foundation for legal truth in achieving justice. This study employs a normative legal research method through a legal approach by examining laws, legal principles, and legal doctrines.
