Abstract

Prinsip pembuktian sederhana merupakan elemen kunci dalam proses kepailitan sebagaimana diatur dalam Pasal 8 ayat (4) UU No. 37/2004. Namun, interpretasi multitafsir atas prinsip ini sering kali menimbulkan ketidakpastian hukum, khususnya dalam kepailitan pengembang apartemen atau rumah susun. Terbitnya SEMA No. 3/2023 memperketat syarat pembuktian sederhana dengan menyatakan bahwa kewajiban utang pengembang tidak dapat dianggap sederhana, sehingga mempersempit akses konsumen untuk menuntut hak melalui proses kepailitan. Penelitian ini mengkaji dua aspek utama, yaitu prinsip pembuktian sederhana dalam kepailitan pengembang apartemen/rumah susun menurut SEMA No. 3/2023, dan perlindungan hukum terhadap konsumen apartemen/rumah susun pasca SEMA No. 3/2023. Metode penelitian yang digunakan adalah normatif dengan pendekatan konseptual dan perundang-undangan. Kepailitan pengembang apartemen atau rumah susun sering terjadi karena ketidakmampuan memenuhi kewajiban utang, termasuk kepada konsumen yang telah membayar tetapi belum menerima unit. SEMA No. 3/2023 membatasi akses konsumen apartemen atau rumah susun ke mekanisme kepailitan, meskipun mereka telah memenuhi kewajiban pembayaran. Pembatasan ini melemahkan posisi konsumen, bertentangan dengan prinsip legalitas dan Pasal 28D ayat (1) UUD 1945, serta mengurangi kepastian hukum. Hal ini juga berisiko merugikan konsumen dan meningkatkan ketidakpercayaan terhadap sektor properti dan sistem peradilan Indonesia. Posisi konsumen dalam transaksi apartemen atau rumah susun rentan terhadap kerugian akibat wanprestasi pengembang. SEMA No. 3/2023 membatasi akses konsumen ke kepailitan, yang mengurangi perlindungan hukum mereka. Meskipun ada perlindungan melalui pengaturan kontrak dan gugatan, implementasi regulasi seperti UU No. 8/1999 dan UU No. 37/2004 masih belum cukup spesifik dalam melindungi konsumen. Penegakan itikad baik dari pengembang sangat penting untuk memastikan pemenuhan hak konsumen dan kepastian hukum. Kata Kunci: Pembuktian Sederhana; Kepailitan; Pengembang; Perlindungan Konsumen.
