Abstract

Kitab Undang-Undang Hukum Acara Pidana (KUHAP) mengatur 3 jenis putusan yang bisa dijatuhkan oleh hakim saat proses peradilan pidana. Muncul persoalan bagaimana apabila ada terdakwa yang berbuat salah dan terbukti secara sah serta meyakinkan, akan tetapi apabila dikenakan suatu pemidanaan maka akan muncul suatu benturan antara kepastian hukum dengan keadilan hukum. Pasal 54 ayat (2) Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP) memperkenalkan asas baru yakni Rechterlijk Pardon, atau yang dikenal sebagai pemaafan hakim. Pasal tersebut memberikan pedoman bagi proses pemidanaan melalui pertimbangan berbagai faktor yang berhubungan dengan keadilan dan kemanusiaan. Pasca penambahan pasal tersebut, muncul pula kebutuhan akan pembaharuan KUHAP dengan penambahan jenis putusan pemaafan hakim dalam Pasal 191 KUHAP. Penelitian ini menggunakan metode penelitian normatif dengan menggunakan sumber primer dan sekunder. Pendekatan penelitian ini menggunakan pendekatan perundang-undangan, pendekatan perbandingan dan pendekatan konseptual. Hasil penelitian ini adalah mengkaji pentingnya penambahan putusan pemaafan hakim dalam Pasal 191 KUHAP agar pembaharuan hukum pidana di Indonesia memiliki satu keselarasan, antara kebutuhan pembaharuan hukum materiil dan formil, serta menciptakan sistem peradilan yang lebih adil, manusiawi, dan responsif terhadap kebutuhan masyarakat. Putusan pemaafan hakim akan ideal jika dimasukkan dalam Pasal 191 ayat (4) KUHAP, dengan syarat terdakwa terbukti melakukan perbuatan tindak pidana, namun hakim menemukan aspek ketidakadilan apabila menjatuhkan hukuman pidana, dan berbagai syarat lain yang diadopsi dari Peraturan Jaksa Agung No. 15 Tahun 2020 dan Peraturan Kepala Kepolisian Negara Republik Indonesia No. 8 Tahun 2021.
