Abstract

Kemunculan pinjaman online sebagai bagian dari industri Fintech memunculkan permasalahan hukum terkait peran ahli waris terhadap tanggung jawab hutang pinjaman online pewaris, terutama karena adanya kekosongan hukum mengenai klausul dalam perjanjian baku yang tertuang dalam kontrak elektronik mengenai pengalihan tanggung jawab pasca meninggalnya pewaris. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian normatif dengan pendekatan peraturan perundang-undangan (Statue Approach) dan pendekatan Konseptual (Conceptual Apptoach). Penelitian ini bertujuan untuk menjawab dua rumusan masalah utama yang menjadi fokus penelitian ini. (1) tanggung jawab ahli waris terhadap pinjaman online pewaris ditinjau berdasarkan hukum waris Burgerlijk Wetboek. (2) tanggung jawab ahli waris terhadap perjanjian pinjaman Online yang lebih besar daripada harta peninggalan yang ditinggalkan pewaris ditinjau berdasarkan hukum waris Burgerlijk Wetboek. Penelitian ini menghasilkan tanggung jawab ahli waris terhadap pinjaman online pewaris dalam konteks waris BW diatur oleh Pasal 833 BW yang menyatakan bahwa ahli waris berhak menerima harta warisan beserta kewajiban utang yang ditinggalkan oleh pewaris. Tanggung jawab ahli waris terhadap pinjaman online yang lebih besar dari harta peninggalan diatur oleh prinsip “saisine”. Tanggung jawab ahli waris terhadap hutang yang lebih besar daripada harta yang ditinggalkan ahli waris diberikan opsi untuk menolak warisan tersebut. Jika utang melebihi harta warisan, ahli waris tidak diwajibkan membayar utang dengan harta pribadi mereka sesuai dengan Pasal 1032 BW yang menerapkan konsep tanggung jawab terbatas.
