Abstract

The protection of privacy rights, including personal data, is recognized as a constitutional right under Article 28G(1) of the 1945 Constitution of the Republic of Indonesia (UUDNRI 1945). In the digital era, personal data has become a valuable asset that is highly vulnerable to misuse, particularly for vulnerable groups such as individuals with physical disabilities. These individuals often face challenges in safeguarding their privacy, especially in the context of data collection and usage by both government and private sectors. The misuse of personal data in the distribution of social assistance and other public services can have severe consequences, including discrimination, identity theft, or exploitation. Indonesia has established a legal framework for the protection of personal data through Law No. 27 of 2022 on Personal Data Protection (Law No. 27 of 2022) and Law No. 8 of 2016 on Persons with Disabilities. However, the implementation of these protections reveals legal gaps, ambiguities, and potential conflicts, particularly concerning the personal data protection of individuals with physical disabilities. Article 26 of the Law No. 27 of 2022, which governs the processing of personal data for persons with disabilities, lacks clarity in its definitions and the mechanisms for providing specific protections for this group. This study aims to examine the legal protection of individuals with physical disabilities against the risk of personal data misuse. Furthermore, it evaluates the regulatory gaps in the Law No. 27 of 2022 that have yet to fully address the needs of individuals with physical disabilities. Through a normative legal approach, this research offers policy recommendations for a more comprehensive framework to safeguard the personal data of individuals with physical disabilities, ensuring that their constitutional rights are fulfilled optimally.
