Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap pers mahasiswa dalam perspektif Undang-Undang Nomor 40 Tahun 1999 tentang Pers. Pers mahasiswa memiliki peran strategis dalam menyuarakan aspirasi mahasiswa, melakukan kontrol sosial, serta mendukung kebebasan berekspresi sebagai bagian dari pilar demokrasi. Namun, keberadaannya belum diakui secara eksplisit dalam UU Pers, sehingga rentan terhadap intimidasi, pembredelan, dan pembatasan dari pihak birokrasi kampus maupun eksternal lainnya. Penelitian ini menggunakan metode penelitian normatif dengan analisis bahan hukum melalui studi pustaka. Data yang digunakan terdiri dari bahan hukum primer, seperti peraturan perundangundangan, dan bahan hukum sekunder berupa literatur serta jurnal yang relevan. Hasil penelitian menunjukkan bahwa pers mahasiswa tidak termasuk dalam definisi pers yang diatur dalam Undang-Undang No. 40 Tahun 1999 Tentang Pers, karena pers mahasiswa tidak berbadan hukum formal. Akibatnya, perlindungan hukum terhadap pers mahasiswa belum maksimal, baik dalam kegiatan jurnalistik maupun dalam penyelesaian sengketa. Oleh karena itu, diperlukan pengaturan khusus untuk pers mahasiswa dalam peraturan perundang-undangan, guna memberikan perlindungan hukum yang setara dan memastikan kebebasan pers mahasiswa dalam menjalankan fungsi jurnalistiknya. Selain itu, perguruan tinggi juga perlu berperan aktif dalam mendukung independensi pers mahasiswa tanpa intervensi yang membatasi.
