Abstract

Penelitian ini menganalisis pengaturan dan mekanisme perampasan asetTindak Pidana Pencucian Uang (TPPU) dari hasil korupsi oleh Kejaksaan.Pengaturan perampasan aset di Indonesia masih menghadapi banyak tantangan, terutama dalam mengimplementasikan standar yang yang diterapkan dalam United Nations Convention Against Corruption (UNCAC), yang di mana Indonesia telah meratifikasi UNCAC melalui Undang-Undang No. 7 Tahun 2006. UNCAC memberikan aturan yang lebih komprehensif bagi negara-negara anggota dalam upaya perampasan aset, termasik melalui mekanisme “civil forfeiture”, “in rem forfeiture” atau Non-Convition Base Asset Forfeiture (NCB), yang belum sepenuhnya diterapkan dalam hukum positif Indonesia serta mekanisme Kejaksaan dalam upaya perampasan aset hasil tindak pidana. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan perundang undangan dan pendekatan konseptual yang menggunakan data kepustakaan, yaitu perundang-undangan, buku, artikel, jurnal, dan penelitian lain yang berfokus pada penelitian ini. Hasil dari penelitian ini menunjukkan bahwa pengaturan perampasan aset di Indonesia belum diatur secara jelas dan mekanisme yang digunakan saat ini masih membutuhkan waktu yang lama karena bergantung pada pembuktian di pengadilan. Kejaksaan juga menghadapi beberapa kendala dalam upaya perampasan aset. Penelitian ini merekomendasikan kepada Pemerintah untuk segera mengesahkan aturan mengenai Perampasan Aset melalui RUU Perampasan Aset guna memperkuat dasar hukum dan dapat memperbaiki mekanisme yang ada.
