Abstract

Hak atas pekerjaan merupakan hak bagi setiap warga negara untuk penghidupan yang layak bagi kemanusiaan. Namun, ketidaksetaraan masih sering dirasakan oleh penyandang disabilitas yang kerap menghadapi tantangan dalam mengakses hak tersebut. Difference principle menyatakan bahwa ketidaksetaraanhanya dapat dibenarkan jika bermanfaat paling banyak bagi kelompok yang paling tidak diuntungkan. Prinsip ini menjadi alat analisis yang tepat untuk mengevaluasi sejauh mana kebijakan ketenagakerjaan di Indonesia telah berhasil meminimalkan ketidaksetaraan yang dihadapi oleh penyandang disabilitas. Sehingga penelitian ini bertujuan untuk menjelaskan dan menganalisis pengaturan hak atas pekerjaan bagi penyandang disabilitas apakah sudah sesuai dengan difference principle. Penelitian ini menggunakan metode yuridis normatif melalui pendekatan perundang-undangandan, pendekatan konseptual dan pendekatan perbandingan. Melalui analisis normatif serta penalaran deduktif, hasil dari penelitian ini menunjukkan bahwa pengaturan hak atas pekerjaan bagi penyandang disabilitas di Indonesia belum sesuai dengan difference principle. Seperti kebijakan kuota khusus yang tidak disertai sanksi tegas, pelatihan dan bursa kerja yang masih bersifat umum dan belum sepenuhnya menjangkau kebutuhan khusus penyandang disabilitas. Proses rekrutmen inklusif yang seharusnya menjadi sebuah kewajiban (mandatory) justru frasa dalam pasal yang mengatur bersifat kemungkinan (optional). Sementara itu, keterbatasan kewenangan yang dimiliki Unit Layanan Disabilitas (ULD) di bidang ketenagakerjaan serta struktur kelembagaan Komisi Nasional Disabilitas (KND) yang lemah dan jauh dari harapan independensi menambah hambatan bagi penyandang disabilitas mendapatkan hak atas pekerjaan. Sedangkan model yang merefleksikan difference principle dapat dilakukan dengan positive discrimination berupa kuota khusus dengan sanksi dan insentif, memberikan akomodasi yang layak bagi penyandang disabilitas, menciptakan akses pekerjaan dan pelatihan yang inklusif, memberikan kewajiban kepada pemberi kerja untuk melakukan prosedur rekrutmen yang inklusif, memberikan pendampingan dan advokasi serta membentuk lembaga pengawasan dan peradilan khusus disabilitas.
