Abstract

Penulisan skripsi bertujuan untuk menganalisa pengaturan Tindak Pidana Pencucian Uang melalui cryptocurrency beserta mekanisme pembuktiannya. Para pelaku kejahatan asal berupaya mencari tempat untuk mencuci uang atau tempat yang tidak bisa menelusuri harta yang dihasilkan dari tindak pidana. Cryptocurrency merupakan bentuk aset yang sulit untuk dilacak karena memiliki sifat anonimitas dan desentralisasi. Metode penulisan skripsi ini menggunakan yuridis normatif. Hasil penelitian yaitu TPPU melalui cryptocurrency dapat dipidana sesuai dengan Undang-Undang Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang. Tantangan penegakan hukum karena sifat anonim dan desentralisasi, kolaborasi Polri-Interpol diperlukan untuk penelusuran aset kripto, mengetahui motif aliran dana, menganalisis pola transaksi, mendapatkan bukti hingga mengakses data kepemilikan aset kripto yang terdaftar di platform perdagangan aset kripto luar negeri yang diduga hasil dari TPPU. Meski demikian terdakwa lah yang diminta untuk membuktikan harta yang bukan merupakan hasil tindak pidana, karena dalam TPPU sistem pembuktian menggunakan pembuktian terbalik.
