Abstract

Polisi memiliki peran penting sebagai penegak hukum dalam masyarakat. Namun, terdapat kasus di mana anggota polisi menyalahgunakan jabatannya, seperti kasus penganiayaan yang disorot dalam penelitian ini. Proses peradilan pidana sering menjadi perhatian publik, menekankan pentingnya penghormatan terhadap asas praduga tak bersalah. Walaupun hak hak tersangka telah diatur dalam undang undang, penyalahgunaan kekuasaan oleh aparat penegak hukum masih sering terjadi, dan hal ini harus dihindari. Perlindungan hak asasi manusia diperlukan bagi semua individu, termasuk pelaku tindak pidana, dan penegakan hukum harus dilakukan secara adil dan sesuai dengan prinsip prinsip hak asasi manusia. Penelitian ini membahas mekanisme perlindungan hukum terhadap korban pelanggaran Hak Asasi Manusia di Indonesia, berdasarkan UU No. 26 Tahun 2000 tentang Pengadilan Pelanggaran Hak Asasi Manusia. Mekanisme ini meliputi perlindungan fisik dan mental, kompensasi, restitusi, dan rehabilitasi, yang juga diatur dalam PP No. 2/2002 dan UU No. 31/2014. Proses penyelesaian kasus pelanggaran hak asasi manusia mencakup penyelidikan oleh Komnas HAM, penyidikan dan penuntutan oleh jaksa agung, dan pemeriksaan di Pengadilan hak asasi manusia. Peran Komisi Kebenaran dan Rekonsiliasi (KKR) dan Peraturan Mahkamah Agung No. 1 Tahun 2022 juga penting dalam memberikan kompensasi dan restitusi kepada korban. Selain itu, penelitian ini mengkaji pertimbangan hakim dalam putusan tindak pidana pelanggaran HAM, khususnya dalam kasus penyiksaan Hendra Syahputra di Rumah Tahanan Polrestabes Medan, yang melibatkan anggota polisi dan tahanan lain. Tindakan kekerasan fisik dan mental yang berulang ulang mengakibatkan kematian korban. Bukti bukti yang digunakan oleh hakim, termasuk Visum Et Repertum, rekaman CCTV, bola karet, dan kaleng rokok, menunjukkan bahwa trauma tumpul menyebabkan perdarahan luas di rongga kepala dan retaknya tulang tengkorak korban. Kesimpulannya, tindakan kekerasan oleh anggota polisi ini merupakan penyalahgunaan kekuasaan yang fatal. Bukti-bukti kuat mendukung putusan hakim, menekankan pentingnya penghormatan terhadap hak asasi manusia dan penegakan hukum yang adil tanpa penyiksaan. Evaluasi menyeluruh terhadap bukti bukti menunjukkan bahwa penyiksaan sistematis dan berulang menyebabkan kematian korban, menuntut pertanggungjawaban serius dari pihak pihak yang terlibat.
