Abstract

This study aims to examine in depth Article 218 of Law Number 1 of 2023 concerning the Criminal Code reviewed from the perspective of the Pancasila legal state. And also to find out how the ratio-legislation and suitability of the regulation of the offense of insulting the President and/or vice president in Law Number 1 of 2023 concerning the Criminal Code with the Pancasila Legal State. In this research method, normative research is used with a legislative approach and a conceptual approach by analyzing primary and secondary legal materials, as well as utilizing applicable literature and regulatory studies. The existence of the offense of insulting the President and/or vice president in Article 218 of the Criminal Code is the result of a recordation that is adjusted to the basic principles of the state, namely Pancasila and the 1945 Constitution. This is intended to maintain and prevent actions that can damage the authority and honor of a President and/or vice president. Where in the Pancasila legal state there are points to develop an attitude that is not arbitrary towards others and upholds human values. In this case, Article 218 of Law Number 1 of 2023 concerning the Criminal Code is in accordance with the Pancasila legal state. This study is expected to provide clarity from various aspects in Article 218 of Law Number 1 of 2023 concerning the Criminal Code.
