Abstract

Children are the successors of the nation who have a future to advance the country. Within a child has inherent and inseparable rights, therefore children's rights must be protected. However, in its development, children's rights continue to experience violations of rights, such as the case of child trafficking or so�calledchild trafficking made by their own parents. So, based on this, the author examines how is the criminal responsibility of parents who trade their own biological children?, and how is the legal protection for child victims of criminal acts of trafficking in persons by biological parents. This research is a normative juridical research carried out using a statutory and conceptual approach by analyzing primary and secondary legal materials. The conclusion from this research is that the criminal responsibility of parents who trade their own biological children can be in the form of providing compensation for crimes that have been committed to their own biological children, and legal protection for child victims of trafficking crimes by biological parents is regulated in the Law Number 21 of 2007 concerning the Eradication of the Crime of Trafficking in Persons in the form of three stages namely protection at the time of the occurrence of a crime, the stage of trial of the perpetrator of the crime and the stage after the court's decision.
