Abstract

Carok is a fighting tradition caused by certain reasons related to self-esteem related to wealth, throne and women, which is done using weapons. This thesis aims to explain and analyze the characteristics of carok in Madura as well as non�penal policies towards carok conflicts in Madura. This is based on the habits of the Madurese people who tend to resolve conflicts involving various issues, such as the election of village heads, family, land and religion with a culture of violence (carok). This research is normative legal research, using two problem approaches, namely the statutory approach and the conceptual approach. Law is generally understood as the content of laws or as rules and norms that function as coercive guidelines for human behavior. This research uses statutory regulations and document studies as a basis for resolving the carok conflict problem in Madura, as well as utilizing secondary materials available in libraries or through library legal research. Based on the research results, it can be stated that the carok conflict in Madura is a symbol that is always attached to Madurese society, as a distinctive character. This is reflected in the expression: "I f a Madurese man does not dare to do carok, then he is not only considered a coward (tako'an) but also not a man (ta' lalake'). Women also ridicule him, which is expressed in a sentence, "Honey, I'm a woman, if I had testicles the size of cayenne peppers, I would do carok."There are even those who say: "Mon ta 'bangal acarok ja' ngako oreng Madura"(if you don't dare to do carok, don't claim to be a Madurese. That carok is one way for Madurese to express their ethnic identity. However, the carok tradition isinherent Madurese society changes over time. This shows the dynamism in the carok tradition, meaning that the carok tradition will always be open to interpretation in relation to the socio-cultural dynamics that occur in Madurese society. The non-penal policy regarding the carok conflict in Madura focuses more on preventive steps (prevention/deterrence/control) before the crime occurs. The steps taken are to address the conducive factors that cause carok conflicts, police patrols, raids, and the use of technology through the press media by broadcasting positive news.
