Abstract

Of the many development sectors, policies regarding land legality are a very important part for people who need legal certainty regarding their land, both land for settlements and land for businesses. In the current cognitive map, people's relationship with the land tends to have to be proven with a certificate. Certificates are important documents in socialreality because they can be used for economic purposes. There are some parties who do not believe in land ownership without written documentary evidence. People consider certificates to be important, but in fact there are still many plots of land that do not yet have certificates. Therefore, Indonesian people should have awareness of land registration. The approach method used, namely normative legal research, consists of 3 methods, namely the approach method in this research using a statutory approach and a conceptual approach, a case approach. Land is an important economic factor and has strategic value from various points of view, both from a social, political or cultural perspective, which cannot be separated from people's lives from the past until now. Apart from that, land is also used as a scarce resource needed to fulfill industrial, trade, service and other activities. Therefore, with the implementation of this land certification program, it is hoped that it will be able to increase economic growth, both from buying and selling activities, renting, granting mortgage rights and so on, so that it can contribute to meeting business needs. In the land registration system with positive publication, a rights registration system is used so that what is registered is the rights to the land, not the legal acts. This impacts the rights holder who is the legal owner of the land. The role of the state is very important in this positive publication system, not only as a guarantor that land registration is carried out correctly, but also the correctness of the data conveyed to the general public. With this positive publication system, the name registered in the land book is considered indisputable, even though it is not the actual owner who has the rights. Therefore, land registration officials are required to have an active role in ensuring the validity of the data.
