Abstract

A child is called a child in the Juvenile Criminal Justice System Law if he is 12 years old but not yet 18 years old and is suspected of committing a crime. In Decision Tondano District Court, Minahasa Regency Number 30/Pid.Sus-Anak/2022/PN.Tnn, children who commit the crime of trafficking in persons are prosecuted under Article 2 Paragraph (1) of the Law on the Eradication of the Crime of Trafficking in Persons with a cumulative penalty in the form of imprisonment and a fine. Then for children, the judge does not impose a prison sentence but rather imposes a sentence with the conditions set out in Article 73 Paragraphs (1) and (6) of the Juvenile Criminal Justice System Law for 1 year and must not commit a crime while serving the sentence with conditions. The formulation of the problem in this research is the ratio decidendi Decision Number 30/Pid.Sus-Anak/2022/PN.Tnn regarding children who are sentenced to punishment with conditions. The method used in this research uses normative legal research methods with a statutory approach, conceptual approach and case approach. The results of this research are that the judge's reasons in his decision to impose a sentence are conditional on the 4 main principles of children's rights, namely the principle of the best interests of the child, respect for the child's opinion, survival and growth and development of the child and non�discrimination. The judge provides protection for the child even though he is the perpetrator and in his decision the judge fulfills two principles regarding children, namely the best interests of the child and the continuation of the child's growth and development.
