Abstract

This research aims to examine the issue of the application of the principle of bank secrecy in the process of eradicating money laundering crimes. Basically, the investigation of money laundering crimes is still a challenge and will be difficult in the handling process, it is because Law No. 25 of 2003 in conjunction with Law No.8 of 2010 concerning Prevention and Eradication of Money Laundering Crimes has not been able to maximally take legal action, not to mention the existence of bank secrecy principles and other related regulations that hinder the investigation process. In terms of blocking and confiscation of funds in the suspect's bank account, the implementers in the field have misinterpreted the application of coercive measures. It is known that blocking is not regulated in the Criminal Procedure Code (KUHAP). For now, the provisions or rules regarding blocking still refer to the Police Force Department Circular Letter Number 028/9/1/EK/67. This research uses normative legal research. The result of this research shows that bank secrets are no longer the main reason for banks to refuse or delay providing information requested by law enforcement officials. The bank must comply with the procedures and mechanisms that have been established by law so that there is no abuse of the principle of confidentiality for improper purposes. In the process of implementing money laundering offences, it is necessary to run systematically, quickly, and precisely with effective law enforcement efforts. In addition, a structured and confidential information exchange mechanism between banks as a place of transaction information and law enforcement is important to strengthen the investigation and investigation process.
