Abstract

Bojonegoro Regency has the ability to exploit non-metal mineral and rock natural resources. The management and utilization of mining resources is quite profitable, thus attracting commercial players and the community in Bojonegoro Regency to process them. However, in practice illegal mining often occurs in Bojonegoro Regency. Law no. 4 of 2009 to regulate the event, which stipulates that initially, a mining business permit is required, with permits being separated into two categories: exploration business permits and production operation mining permits. The formulation of the problem in this research is what is the nature of non-metal mineral and rock mining permits in Bojonegoro Regency and how is the law enforcement of non-metal mineral and rock mining in Bojonegoro Regency. This study uses empirical normative methods with a case approach that exists in the community of Bojonegoro Regency. This research shows that with the enactment of law enforcement regulations regarding non-metallic minerals and rocks in Bojonegoro Regency, the mining mechanism must meet the licensing requirements according to the regulations that have been stipulated. However, in fact, law enforcement against illegal mining crimes has not been implemented optimally because the Bojonegoro Regency government has only been involved in outreach to date, without taking any significant steps.
