Abstract

The problem of domestic violence is still often experienced, especially by women. This violence includes various forms such as physical, psychological, sexual and economic, which can have a serious impact on the health and well�being of the victim. Domestic Violence can be committed by anyone against anyone, including members of the military, which often results in victims of their wives. Military members receive education, training and preparation for war, but their existence in a hierarchical structure and stressful working conditions can be a risk factor for domestic violence. As in case 95-K/Pm Ii�08/Ad/Iv/2016, effective protection and law enforcement efforts are very important to overcome this problem and provide adequate protection for victims of domestic violence. Therefore, this thesis focuses on and applies criminal law to criminal acts of domestic violence committed by the TNI which have an impact on psychology as well as legal protection and the judge's legal considerations in case 95-K/Pm Ii-08/Ad/Iv/2016 in imposing sentences for criminal acts of domestic violence which have a psychological impact. The judge's decision to impose a sentence by sentencing the defendant to imprisonment for 6 (six) months with a probation period of 10 (ten) months is appropriate and in accordance with the defense and decides Article 44 paragraph (1) of the Law of the Republic of Indonesia Number 23 of 2004 concerning the Elimination of Domestic Violence in conjunction with Article 14a of the Criminal Code. However, in terms of protection for victims, it is still not carried out optimally. A person who is a victim of domestic violence should be given maximum protection through local protection agencies.
