Abstract

This research discusses the rules for carrying babies during detention and prison for female prisoners using normative legal research methods with statutory, case and comparative approaches. The aim of the research is to ensure that detainees and convicts and their children continue to receive the rights they should and how the state protects the rights of detainees and convicts during the period of detention and prison. Law No. 22 of 2022 provides clearer provisions regarding correctional institutions which also contain regulations regarding the right to carry a baby during detention and prison for female prisoners and prisoners as well as the state's responsibility for holding babies and female prisoners while in detention cells and prison. However, in the written arrangements there is a vacuum in norms which are felt to influence the achievement of the rights that detainees and prisoners and their children (babies) should have. Adequate legal support and assistance is very necessary to ensure that the rights of detainees and convicts are maintained and ensured that they are not violated by anyone. It is hoped that this research can strengthen the fulfillment of the rights that women detainees and prisoners and their children (babies) should have.
