Abstract

This research reviews the authority of the National Narcotics Agency (BNN) and Police Investigators in investigating narcotics criminal cases. Authority is the right to use the authority possessed by an official or institution according to applicable regulations, authority also concerns the competence of legal actions that can be carried out according to formal methods. The authority of the BNN in investigating narcotics offences is broader than that of police investigators. This research aims to understand the differences in the authority of BNN and Police investigators in handling narcotics crimes and a comparison of narcotics criminal investigations in Singapore and Indonesia. This research uses normative legal research methods to examine the authority of BNN and Police investigators in narcotics criminal cases. The findings of this research show that the authorities of the two institutions in narcotics offences still overlap, and must be replaced so that there are no conflicting regulations. The result of this research itself aims to determine the authority of BNN and Police investigators in the investigation of narcotics crimes. The authority of investigation for criminal acts of narcotics abusers or small scale is investigated by BNN with an arrest time limit of 3x24 hours and increased by 3x24 hours and for dealers investigated by narcotics investigators from the police with an arrest time of 1x24 hours. and to find out the comparison of narcotics criminal investigations in Singapore and Indonesia, which for Singapore itself the investigation is carried out by the police as well as the CNB (Central Narcotics Bureau) with an arrest time of 2x24 hours (48 hours). The conclusion of this research is that the authority of BNN regulated in Law No. 35 of 2009 has 27 authorities which are broader than the authority of Police Investigators regulated in the Criminal Procedure Code (KUHAP) in investigating narcotics offences. For comparison, investigations in Singapore are carried out by the CNB which is regulated in the CPC (Criminal Procedure Code) 2010 and the Misuse Of Act 1973 and in Indonesia, investigations are carried out by BNN or Police Investigators.
