Abstract

The independence of constitutional judges is a key prerequisite for a just and secure rule of law. This principle must be reflected in the examination and decision-making, ensuring judges are free from outside influences such as political intervention or partiality of certain groups or individuals. However, the independence of the Constitutional Court was questioned after the case that befell the Chief Justice of the Constitutional Court Anwar Usman regarding the Constitutional Court Decision No. 90/PUU-XXI/2023 concerning the age limit for presidential and vice presidential candidates. In this decision, there were many issues that eventually led to controversy, one of which was a conflict of interest. This phenomenon may have to be addressed as an effort to improve the supervisory function carried out by the Constitutional Court through the MKMK. This thesis research aims to explain the position of the honorary council of the constitutional court and to find out and explain the legal force of the decision of the honorary council of the constitutional court against the decision of the constitutional court whose judges violate the code of ethics. This research is a normative legal research using statute approach, conceptual approach and case approach. The results of this study indicate that the Constitutional Court (MK) and the Judicial Commission (KY) are part of the judicial power in Indonesia within a democratic framework that applies the principle of trias politica, with each institution having its own authority. KY, based on Article 24B paragraph 1 of the 1945 Constitution, has the authority to supervise the behavior of judges to maintain the honor and dignity of judges. However, KY's supervision of MK judges caused conflict, so through Decision No. 005/PUU-VI/2006, the Constitutional Court stated that such supervision was contrary to the 1945 Constitution. As a solution, the Court established an internal supervision mechanism (MKMK) in accordance with Law No. 7 of 2020 and strengthened by PMK No. 1 of 2023. MKMK has the authority to monitor, examine, and recommend actions against constitutional judges who violate the code of ethics. the issue of legal assessment of Constitutional Court decisions and also questioning the validity or invalidity of a Constitutional Court decision is no longer the authority of MKMK.
