Abstract

This research aims to examine the legal protection for whistleblowers in the context of corruption crimes from a comparative perspective between Indonesia and the United States. The study employs a normative legal research method. The approach used in this research involves legislative analysis and conceptual approach. The findings of this research indicate that the criminalization is essential for perpetrators of same-sex rape against adults in Indonesia. Legal protection for whistleblowers is not regulated in Indonesian legislation. Referring to Law Number 13 of 2006, the article only pertains to the protection of witnesses, while in the United States, there is the Sarbanes- Oxley Act (SOX) of 2002. Section 806 of SOX provides legal protection for employees who report violations of federal law. Regarding the interpretation of the term "whistleblower," it refers to someone who exposes secretive or illegal activities within an organization, typically governmental or corporate, to internal or external parties. They draw attention to violations, often at significant personal risk, with the aim of promoting transparency and accountability. Whistleblowers play a crucial role in uncovering corruption, fraud, safety violations, and other inappropriate behaviors that may remain hidden. They are protected by various laws in many countries to shield them from retaliation for their disclosures.
