Abstract
In fulfilling children's rights after divorce, most parents do not carry out their obligations to support their children and there are no legal sanctions for parents who do not carry out these obligations. This is the background to the issues raised, namely what are the legal sanctions for parents who do not carry out their support obligations towards children after divorce and what are the provisions for support obligations towards children after divorce from the perspective of Islamic law and positive law in Indonesia. This type of research is library research, with primary legal materials and secondary legal materials, then analyzed as expected based on normative descriptive analysis. The results of the research show that there are disparities in legal sanctions for parents who do not carry out their obligations to support their children after divorce from an Islamic legal perspective, namely the opinion of Hanafi ulama' that the child's previous support becomes the father's debt even though he is poor, so that when he is already capable, father is obliged to replace it. If the father is capable, but refuses to provide support to the child, then the judge is obliged to force the father to pay. According to the Syafi'i school of thought, Hambali and Maliki are of the opinion that a child's previous support will be forfeited unless there is a decision from a judge. Meanwhile, according to positive law in Indonesia, legal sanctions for parents who neglect their child support obligations can be subject to civil or criminal sanctions. Based on the provisions of Islamic law regarding the obligations of parents in supporting their children's lives until adulthood after divorce, the burden is more on both parents and their children as stated in Article 77 of the Compilation of Islamic Law "Husband and wife bear the obligation to care for and care for their children both regarding their physical, spiritual and spiritual growth. and the educational intelligence of their children." Meanwhile, according to the provisions of positive law in Indonesia, it is stated that parents have a responsibility to children in providing support until the child feels able to stand on his own two feet, but there are regulations that lighten the responsibility of parents in providing support for children, if the father is deemed unable to provide child support, in this case the mother can assist as regulated in Article 41 letter b of Law no. 16 of 2019 concerning Marriage which states "The father is responsible for all maintenance and education costs required by the child, if the father is in fact unable or unable to provide support then the court can determine that the mother also bears these costs"
