Abstract
Book Letter C and Petok D, although after the enactment of the UUPA are no longer evidence of land tenure, but Article 24 of PP No. 24 of 1997 still gives recognition as old written evidence as a requirement for registration of land rights. The problem is what is the Ratio Decidendi of Decision No. 190/Pdt.G/ 2005/ PN.Sby jo Decision No. 494/PDT/2007/PT.SBY jo Decision No.2340 K/PDT/2008 jo Decision No.233 PK/Pdt/2011 and what is the legal position of the buyer of land rights on evidence of petok d who is not entitled. The research used as an approach is normative juridical based on the basis and concept, obtained a research result as follows: Land rights with proof of Book Letter C and Petok D are allowed as Article 39 of PP No. 24 of 1997, but if Book Letter C and Petok D are engineered by changing the name recorded in it, it is a prohibited act and the judge in his consideration canceled Book Letter C and Petok D. Buyers of land rights with proof of Book Letter C and Petok D from sellers who are not entitled to sell it and canceled by the court judge can sue the seller on the basis of having committed an unlawful act.
