Abstract

In principle, creditors holding pledges, fiduciary guarantees, mortgage rights, mortgages, or collateral rights for other objects (separatist creditors) can execute their rights as if bankruptcy had not occurred based on Article 55 paragraph (1) of Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations (Bankruptcy Law and PKPU). Carrying out collateral execution within a period of 2 (two) months as intended in Article 59 paragraph (1) of the Bankruptcy Law and PKPU is very difficult for separatist creditors. The curator's obligation to ask the separatist creditor to hand over the objects that are collateral for subsequent sale in public at the end of a period of 2 (two) months after the start of the insolvency situation is very difficult to carry out because there are no arrangements regarding legal action that can be taken by the curator if separatist creditors do not hand over the objects that serve as collateral. Based on this background, the formulation of the problem is: 1. Is the determination of a time limit of 2 (two) months after the start of the insolvency situation for separatist creditors to exercise their rights contrary to the principle of material rights. 2. What are the legal consequences for the curator of having completed the determination of the time limit of 2 (two) months after the start of the state of insolvency by separatist creditors to exercise their rights. The conclusions from the thesis research are as follows: First, the provisions of Article 59 paragraph (1) of the Bankruptcy Law and PKPU conflict with the principles of property rights regulated in Article 6 of Law Number 4 of 1996 concerning Mortgage Rights (UU Mortgage Rights) and Article 29 paragraph (1) letter b of Law Number 42 of 1999 concerning Fiduciary Guarantees (Fiduciary Law), but with the existence of the lex specialis derogat legi generali principle, namely the Bankruptcy Law and PKPU, it can override the Mortgage Law and Fiduciary Law. Second, with the expiry of the 2 (two) month period after the insolvency situation began, the curator must ask the separatist creditor to hand over the objects that are collateral for further sale in public (auction). So, to guarantee and protect the rights of other creditors who have receivables from the debtor, legal action is needed for the curator if the separatist creditor does not hand over the objects that are collateral to the curator.
