Abstract

This research examines legal protection for debtors in the process of debt transfer by creditors, which often leaves debtors in a disadvantageous position due to the power imbalance between the two parties. Debt transfers are often carried out without approval or notification to the debtor, so that the debtor is atrisk of facing uncertainty regarding the party authorized to collect the debt and new payment terms. This research uses normative research methods with a statutory regulation approach, analysis of legal concepts, and case studies, which aims to understand existing legal protection and identify shortcomings. The research results show that although there are regulations regarding debt transfer, their implementation is still less than optimal in protecting debtor rights. Existing laws do not yet require the debtor's consent before the transfer of debt and there is no adequate notification obligation from the creditor, causing confusion and uncertainty for the debtor, especially if the new creditor imposes more burdensome conditions. This research concludes that there is a need to revise regulations to strengthen legal protection for debtors, including the obligation for creditors to obtain written approval from debtors and provide clear notification regarding changes that occur, so that the debtor's position is more secure and a balance between the rights of creditors and debtors can be achieved.
