Abstract

In Article paragraph (3) of Law No. 17 of 2023 Concerning Health, there is a phrase that states that under certain conditions the pharmaceutical practice as referred to in paragraph (1) may be performed by other health personnel other than pharmaceutical personnel. The purpose of this thesis research is to determine the mechanism and responsibilities of other health workers who replace pharmaceutical workers in Law Number 17 of 2023 Concerning Health. The method used in this research is normative legal research and uses three approaches, namely the statutory approach, conceptual approach and case approach. The results of the discussion of this thesis are as follows, the mechanisms that can be taken if there is a change from pharmaceutical personnel to other health workers are: 1) The delegation of authority must be done in writing including clear instructions regarding its implementation, how to act if complications arise and so on; 2) Delegation of authority can only be done if the pharmaceutical worker is convinced that the other health worker who receives the delegation is able to carry out the task properly; 3) In the implementation of delegation, there does not have to be guidance and supervision from the pharmaceutical worker; 4) Refusal of delegation of authority may be made if the delegatee feels incapable of performing the action; and 5) The delegated action may not be performed continuously or may be performed only under certain conditions. The responsibilities of other health workers who replace pharmaceutical workers are as follows: 1) Because of the nature of the delegation, the responsibility lies with the other health worker and no longer with the pharmaceutical worker and 2) Not entitled to convey the results of actions taken by other health workers to the pharmaceutical worker who has delegated their authority.
