Abstract

The purpose of the research is to find out how the characteristics of negligent medical acts and how the settlement of medical disputes due to negligent medical acts based on restorative justice. The type of research used in this writing is normative legal research that uses a conceptual approach and case approach. The results of this research show that the characteristics of negligence in medical actions are as follows: 1) the handling of the patient is not in accordance with professional medical standards, 2) there is no element of prudence, 3) there is an element of negligence, 4) there are no prevention efforts, and 5) there is no contributory negligence (when the injured patient is considered to be responsible for his own injury) and Restorative Justice can be constructed by holding a meeting of all interested stakeholders such as, the hospital director, chairman of the IDI, the patient's family, the doctor concerned, community leaders, the police, witnesses and so on to sit together and deliberate in order to reach an agreement.
