Abstract

Sexual violence is currently increasingly common in the tertiary environment, which raises a fundamental question: why do these acts still often occur in institutions that are supposed to be safe places for students to study with high ethical standards, as centers for the development of science and culture, universities? height should be a protector for students. However, in reality, several universities in Indonesia have witnessed cases of sexual violence involving students, teaching staff and education staff. The aim of this research is to find out how legal protection is for victims of sexual violence in tertiary institutions. Empowering victims through providing clear information about their rights and supporting their access to psychological support services is a key step in improving legal protection. In addition, it is important to strengthen reporting mechanisms and support victims during the legal process. The research concluded that, legal protection for victims of sexual violence in higher education is regulated in Article 12 of Minister of Education and Culture Regulation Number 30 of 2021 concerning Prevention and Handling of Sexual Violence (PPKS) in the Higher Education Environment. In addition, perpetrators of sexual violence in higher education are subject to administrative sanctions as regulated in Article 14 and Article 16. The advice given in this research is the need to regulate sanctions for universities if they do not fulfill the protection of victims or witnesses, as in article 12 of Minister of Education and Culture Regulation Number 30 of 2021.
