Abstract

The income of Civil Servants (PNS) or State Civil Apparatus (ASN) which only depends on their monthly salary sometimes forces them to look for other sources of income in order to fulfill their consumer needs. Bank credit is one solution to overcome this problem and to get it you need something that can guarantee repayment of the credit. The guarantee used by these Civil Servants is their Retirement Decree (SK) as a former Civil Servant. Although a Civil Servant Decree is not an object that has transfer value, in banking practice this Decree can be accepted as collateral for bank credit. Guarantee for immovable objects in the field of banking law regarding this discussion regarding Fiduciary Guarantees. So in this discussion the Decree for Retired Civil Servants is included in the Fiduciary Guarantee category. The aim of this research is to determine and analyze the legality of the State Civil Apparatus Pension Decree (ASN) which is used as collateral for banking credit. Research findings refer to the legality of the Pension Decree which is used as collateral for banking credit, so that in this case it discusses and analyzes it specifically and systematically and is supported by applicable laws and regulations. The research method used in preparing the thesis is a normative legal research method using library materials as the main source for analyzing legal problems. Approach This research uses a statutory regulatory approach (statute approach) and a conceptual approach (conceptual approach). Benefits of this research can contribute ideas to the development of legal science, especially banking law. The results of this research focus on the Decree on Retirement of State Civil Apparatus (ASN), which is material collateral that has economic value and can be used as collateral for banking credit.
