Abstract

In social life, every individual is subject to rules, both customary law and government regulations, in order to create order and peace. This principle is in line with the national ideals in the Preamble to the 1945 Constitution which emphasizes the protection of citizens, increasing welfare, education and world order. Law Number 35 of 2009 concerning Narcotics regulates heavy sanctions for violators, as well as clear rehabilitation procedures and standards, to ensure fair and transparent law enforcement. This law also recognizes narcotics addicts as victims who need rehabilitation, apart from being perpetrators of criminal acts. This research examines doctrines in legal science using a statutory approach and a conceptual approach. The legislative approach analyzes regulations related to certain legal issues, aiming to solve legal issues based on the function and purpose of each regulation. Meanwhile, the conceptual approach examines legal views and doctrines to build strong legal arguments in resolving issues. In this research, the legal materials used include primary legal materials (legislation, official minutes, judge's decisions) and secondary legal materials (legal literature, journals, dissertations, theses). The technique for collecting legal materials involves literature study and internet searches, then analyzed deductively to link general legal theory and the specific problems faced. The systematic writing consists of an introduction, literature review, discussion and conclusion, with a focus on classifying rehabilitation and criminal systems for narcotics users, as well as obstacles in implementing rehabilitation in accordance with Law Number 35 of 2009. Conclusions and suggestions emphasize the integration of rehabilitative and punitive approaches as well as increasing coordination between related institutions and fair law enforcement.
