Abstract

This research examines the regulation of personal vaporizer sales to children, as well as the legal protection of children from the dangers of personal vaporizer (vape) use in Indonesia, and the legal and ethical responsibilities of business actors in their sales. The method used is a normative study of various relevant regulations, including the Health Law, Child Protection Law, PP No. 109/2012, PMK No. 146/PMK.010/2017, and Consumer Protection Law (UUPK), as well as business ethics principles. The results show that although there are already regulations governing the sale of tobacco products, there is still norm ambiguity because it is not firm and clear regarding the regulation of personal vaporizer sales to children, and obstacles in enforcement, especially in verifying the age of the buyer. The analysis also includes the responsibilities of business legal actors based on UUPK and principles of legal responsibility. Aspects of business ethics such as autonomy, honesty, fairness, mutual benefit, and moral integrity are also discussed in the context of vape sales. This research concludes that there is a need to increase legal protection of children from the dangers of vape through improved regulations, more effective law enforcement, and increased public awareness. Recommendations include strengthening age verification mechanisms, and broader educational campaigns on the dangers of vaping for children.
