Abstract

This study aims to examine the reasons for the judge in making a decision (ratio Decidendi) on the Supreme Court decision number 2086 K/Pid.Sus / 2023 with Defendant Gusti Ayu Dewanti aka Dea Onlyfans who was found guilty of committing a pornographic crime by selling pornographic content to one of the public figures on behalf of Marshel Widianto. From these cases, there is a lack of clarity/vagueness of the law in the current rules, where someone who purchases pornographic content can be free from the bondage of criminal law. The impact that will happen if this continues in the future, will be many consumers or buyers of pornographic content more freely in carrying out their actions. It can also worsen the prevailing norm. The formulation of the problem that will be examined is how the ratio Decidendi of the Supreme Court decision number 2086 K/Pid.Sus / 2023 against the perpetrators of sellers and buyers selling and buying pornographic content and how the legal consequences of the perpetrators of sellers and buyers selling and buying pornographic content on the Onlyfans page. The research method used in this study is normative legal research. The approaches used in this study are legal approach and case approach. The result of this study is that in these cases the judge's decision has not been able to provide justice and legal certainty to the community. Because in this case the perpetrator of the buyer can not be entangled in the criminal by reason of consideration by the judge of the absence of criminal elements that meet and the absence of rules in peruandang-invitation in Indonesia which regulates it as a prohibition to the buyers of pornographic content.
