Abstract
This thesis aims to determine the formation of Virtual Police in Indonesia in terms of Article 28E paragraph (3) of the 1945 Indonesian constitution. This topic is interesting to study because the mechanism carried out by the Virtual Police unit is not in accordance with the initial purpose of its formation based on SE number 2/11/2021 on ethical cultural awareness to realize a clean, healthy and productive Indonesian Digital space. The establishment of Virtual Police in the perspective of Article 28E paragraph (3) of the Constitution of the Republic of Indonesia in 1945 is an effort to balance between protecting freedom of opinion and expression by maintaining order and security in the digital space. However, this freedom is not absolute and must be balanced with responsibility so as not to infringe on the rights of others. Virtual Police was formed in response to the rise of cybercrime, including the spread of hoaxes, hate speech, and information that could threaten social stability and national security. Using advanced technology, the Virtual Police is tasked with monitoring, identifying, and cracking down on violations in cyberspace in accordance with applicable law. The research method used in this study is normative juridical Law Research (legal research). While the approach used in this study is a statutory approach (statue approach), concept approach (conceptual approach), case approach (case approach) and the legal materials used are primary legal materials and secondary legal materials. Based on the results of this study, the establishment of the Virtual Police must be carried out carefully to ensure that its implementation does not violate the principles of democracy and human rights guaranteed by the Constitution, and still uphold the freedom of opinion stipulated in Article 28E paragraph (3) of the 1945 Indonesian constitution and limits on content content that needs to be monitored by the Virtual Police including the spread of hoaxes, hate speech, provocative content, and information that threatens public order and national security.
