Abstract
Technology, publications, and entertainment licensing, and brand and merchandise licensing are three types of licenses known under the field of intellectual property. Talking about commercialization means discussing profit and loss between sellers and buyers. Intellectual Property Rights (also known as IPR) basically include intellectual property rights, which are owned by the owner and permanent and exclusive rights owned by other parties with the owner's permission, such as announcing, reproducing, using, or producing certain products. OnlyFans itself is a subscription social media platform that allows content creators to monetize their adult, explicit, or non-adult content. Users, often referred to as "creators," can upload various types of content, including photos, videos, and direct messages, and then set monthly subscription fees for other users who want to access that content. The type of research used in this research is normative legal research. According to Peter Mahmud Marzuki, normative legal research is prescriptive in nature, where the object of legal science is coherence between legal norms and legal principles, between legal rules and legal norms, and between individual behavior and legal norms. Article 1 Paragraph (1) of the Copyright Law explains that Copyright is an exclusive right that is automatically obtained by the Creator when his work is realized in material form, while still observing the limitations set by law. In paragraph (2), it is explained that creators can be individuals or groups who independently or jointly create works that have unique characteristics and are personal in nature. Therefore, exclusive rights in Copyright are only owned by the Creator himself, either as an individual or a group. If conclusions are drawn from the opinions of R. Soesilo and S.R. Sianturi that morality is something that is not only related to genital desire and sexuality. But also actions that are in accordance with the nature of society in a particular society judge these actions as inappropriate and immoral. So basically the Criminal Code includes pornography as a morality offense because pornography issues are seen more from the perspective of morality issues.
