Abstract

Hospitals are health care facilities managed by the government and the private sector, which aim to achieve the right to health care. This is manifested in the form of legal relations between doctors and patients that should be managed properly and correctly based on applicable legal principles. This research was conducted to find out how the legitimacy of doctors to carry out their duties in providing health services in hospitals needed by the Indonesian people. This research is a normative legal research, with a legislative approach and conceptual approach. The results of this study conclude that the legality of practising doctors in hospitals, namely the legality of doctor practice is regulated in Law of the Republic of Indonesia No. 17 of 2023 concerning Health, which is marked by the fulfillment of administrative requirements, namely ownership of a Registration Certificate (STR) in article 260 paragraph (1) and a Practice Permit (SIP) in article 263 paragraph (1 and 2). In addition, Clinical Appointment and Clinical Privilege are given through credentials at the Hospital in accordance with Permenkes Number 755/MENKES/PER/IV/2011 concerning the Implementation of the Medical Committee in Hospitals. Falsification by doctors results in potential malpractice and medical maladministration that can occur in hospitals. The legal consequences for the hospital are as stated in Article 193 of the Law of the Republic of Indonesia 17 of 2023 concerning Health that the Hospital is legally responsible for all losses caused by negligence committed by Hospital Health Human Resources.
