Abstract

Witness testimony is the first form of evidence in the Criminal Procedure Code, so it can be said that no criminal case escapes the verification of witness testimony. The condition for valid witness testimony is when a witness takes an oath. However, article 171 letter b of the Criminal Procedure Code states that a person may give information without oath, namely a person who experiences memory problems or mental illness, although sometimes his memory returns, in the science of mental illness, it is called a psychopath, but the information given cannot be fully justified and the information is only used. as a guide or additional legal evidence as long as it is in accordance with the legal evidence. There are two formulations of the problem in this research, namely, first, whether ODGJ can be questioned as a witness in a criminal case, and second, what is the evidentiary strength of the testimony of ODGJ witnesses in criminal cases. This research uses normative juridical with a statutory approach, a conceptual approach, and a case approach. The meaning of the terms memory sickness or mental illness and psychopath is not found in psychiatry. Based on psychiatric science, the correct term is mental disorder and does not recognize the term mental illness, for this reason in Article 171 letter b of the Criminal Procedure Code, the point is taken, namely, not being sworn in because it cannot be fully accounted for in criminal law. Witness statements given without oath are considered not to be valid evidence but are used as an addition to enhance the evidentiary strength of valid evidence because they can strengthen the judge's belief.
