Abstract

Law Number 2 of 2014 on the Amendment to Law Number 30 of 2004 on the Position of Notary Article 16 paragraph (1) letter e states that Notaries in carrying out their duties are required to attach letters and documents and fingerprints. However, the main problem lies in the emptiness of norms regarding the validity of notarial deeds made if fingerprints are not attached to the deed minutes and legal protection for notaries if they do not fulfill this obligation. The purpose of this research is to find the validity of notarial deeds without attaching the fingerprints of the faces to the minutes of the deed and to find legal protection for notaries who do not attach the fingerprints of the faces to the minutes of the deed. This research method is normative legal research, this research uses a statutory approach and a concept approach. From the findings of this thesis, it is found that the existence of the deed minutes without the fingerprints of the faces attached, still has validity as an authentic deed and has a guarantee of legal certainty, as long as the making is carried out in accordance with the authority, procedures and forms required by UUJN and legal protection for notaries who do not attach the fingerprints of the faces to the deed minutes is the imposition of administrative sanctions as a form of repressive legal protection and not criminal or civil sanctions.
