Abstract

The importance of employment in Indonesia is one of the main factors of national development, so efforts are needed to direct, train and provide education about employment protection in order to create safety and health for workers regarding employment in Indonesia. Workers' health protection is also related to health risks and work accidents that have occurred in companies, for example FMCG (Fast Moving Consumer Goods) companies or factories that focus on the production and distribution of consumer goods that have high demand and fast turnover in the market such as instant noodles, bottled water, toothpaste, and milk. This research discusses how to implement worker health and safety protection from a juridical perspective, as well as what the obligations of the government and companies are in protecting workers due to exposure to dangerous chemicals. The methods used in this research are the statutory conceptual and the case conseptual. Analysis of primary legal materials was carried out by detailing the main sources of legislation, namely Law Number 2 of 2022 concerning job copyright. The author's results regarding legal protection related to exposure to chemicals in factories are not yet optimal in fulfilling workers' rights in the field of occupational safety, especially workers' health, because in its implementation factories often exceed the limits on the use of chemicals, and are not accompanied by management of personal protective equipment, health checks, and health insurance for workers. Therefore, the legal consequences resulting from negligence in fulfilling the rights to health and safety of workers in factories can be overcome either through a non-litigation approach or through the litigation process.
