Abstract

In this study, there are two formulations of the problem, namely how to regulate rehabilitation for pedophiles who are subject to additional sanctions for chemical castration based on humanitarian principles and how to model regulations on rehabilitation for pedophiles who are subject to additional sanctions for chemical castration based on humanitarian principles. While the purpose of this study is to analyze the regulation on rehabilitation for pedophiles who are subject to additional sanctions of chemical castration based on humanitarian principles and to analyze the regulatory model of rehabilitation for pedophiles who are subject to additional sanctions of chemical castration based on humanitarian principles. The type of research used in this study is normative research. Which in this subject analyzes the rehabilitation for pedophiles convicted of chemical castration based on humanitarian principles using theories that are sustainable with it. That is by using legal protection theory, child protection theory and punishment theory. The results of this study are: 1) Regulations regarding rehabilitation for pedophiles are indeed regulated in Government Regulation Number 70 of 2020 concerning Procedures for the Implementation of Chemical Castration Measures, Installation of Electronic Detection Devices, Rehabilitation, and Announcement of the Identity of Perpetrators of Sexual Violence Against Children. However, the government regulation is still ambiguous, so there needs to be special rules on rehabilitation procedures for pedophiles who are subject to additional sanctions for chemical castration; and 2) Model regulation on rehabilitation for pedophiles subject to additional sanctions for chemical castration based on humanitarian principles, namely in the form of government regulations on procedures for implementing rehabilitation for pedophiles. In the government regulation, it must aim to restore the condition of pedophiles.
