Abstract
This thesis research aims to find out more about whether the act of euthanasia against patients in terminal conditions with family consent is appropriate in terms of the medical code of ethics, and human rights. The research method used in this research is normative legal research method with statute approach, conceptual approach, and comparative approach. The act of euthanasia in Indonesia still invites pros and cons, this is due to the vagueness of the regulations regarding euthanasia both in terms of the Indonesian Medical Code of Ethics 2012 interpreting it as an act of ending life, besides that in terms of Human Rights both in the UUD NRI 1945 and Law No. 39/1999 still uphold the right to life of each individual, so that euthanasia as the right to die is seen as an act that is ethically and legally contradictory. If doctors do so, it will lead to ethical sanctions and criminal sanctions in Article 344 of Law No. 1/1946 or Article 461 of Law No. 1/2023 even though there is a Permenkes No. 37/2014 which regulates several procedures for terminating medical actions as these procedures can be used as guidelines for doctors in carrying out euthanasia against patients suffering from terminal illnesses and are in a brainstem death condition. Belgium and Luxembourg have legalised euthanasia in their respective laws by stipulating that doctors can perform euthanasia on patients if they fulfil the procedures, so that if their actions have fulfilled the specified procedures then their actions can be considered not as actions that are contrary to the law and can’t be subject to criminal sanctions. Reflecting on the Belgian Euthanasia Law and the Luxembourg Euthanasia Law, the Indonesian State with the existence of Permenkes No. 37/2014 should be able to provide legal certainty for doctors in carrying out euthanasia against patients suffering from terminal illnesses and are in a brainstem death condition, so that if the doctor does it by fulfilling the procedures stipulated in the regulation, it is actually appropriate because the action is not an act of murder so that it is not an act that is contrary to the Indonesian Medical Code of Ethics 2012 and the UUD NRI 1945 and/or Law No. 39/1999.
