Abstract

The crime of insulting is often referred to as a crime of honor. The presence of the offense of insult in the 2023 Nasopnal Criminal Code is intended to protect someone's honor. In actions that are considered insulting, it is not only honor that must be protected but also one's good name. The aim of this research is to find out and analyze the legal provisions for the criminal act of insulting the president based on law number 1 of 2023 and to find out and analyze the restrictions on the right to freedom of opinion associated with the criminal act of insulting the president. This type of research uses normative legal research. The problem approach method uses a statutory approach, a conceptual approach method, and an analytical approach method using primary legal material sources, secondary material sources and tertiary legal materials. Meanwhile, techniques for collecting and processing legal materials for literature study are analyzed qualitatively. The research results of the Criminal Code itself do not specifically regulate insults and the debate regarding the article on insulting the president is still ongoing in Indonesia, and a balanced solution is needed between protecting the dignity of the president and freedom of expression for the Indonesian people. Previously, the article on insulting the president was contained in the Law Code. National Criminal Code (KUHP) 2023, namely Article 207 of the Criminal Code. The article regarding insulting the president is considered inconsistent with democratic principles and human rights because it can threaten press freedom and the right to freedom of expression.
