Abstract

This study aims to analyze the Ratio Decidendi decision in criminal case number 989/Pid.Sus/2021/Pn Bdg and analyze the legal protection for the rights of children resulting from rape in case number 989/Pid.Sus/2021/Pn Bdg. The research method used in this research is normative legal research using an approach that includes a Statutory approach, a conceptual approach and a case approach, data sources obtained Jtom primary legal materials, secondary law and tertiary legal materials, processing legal materials Ihrough the stages of editing, systematization and description and deductive analysis. The results of this study show that the Ratio Decidendi Of the Panel of Judges regarding the defendant's actions as "The most serious crime" for minors, but not imposing the death penalty because it is Contrary to Human Rights is wrong and lacks clarity. Legal protection for children resulting from rape in case No.989/PID.SUS/ 2021/PN.Bdg was less considered by the judge, in his consideration the judge placed more emphasis on the interests Of child victims or mothers Of children victims of sexual violence and then related to legal protection for children resulting from rape. rape, s0 that children resulting from rape receive certainty regarding legal protection, children resulting from rape must be positioned as victims of sexual violence.
