Abstract

Granting conditional release is indeed the right of every convici. However, in terms of granting conditional release, social, economic, political and cultural perspectives must be considered. This is s0 that the granting of prisoners' rights does not undermine the people's trust in law enforcement in Indonesia. One of the conditional releases that is being debated in society is the conditional release given to perpetrators of corruption. This is because corruption is an extraordinary crime. With the existence of remissions and parole, it is certain that there will not bea deterrent effect because convicts in corruption cases will be released more guickly Ihan the time determined by the judge in court. The granting of the right to parole can also result in a decrease in public trust in law enforcement officials. This is because law enforcers can be seen as not really committed to eradicating corruption and opportunities to do the same for corruption will be wide open because the criminal justice system does not provide a deterrent effect for perpetrators of corruption. Because the crime of corruption is considered as an obstacle to the economy and development of a country, this is because the crime of corruption is ad crime that is detrimental to state finances. In addition to harming the country's finances and/or economy, corruption is also seen asa criminal act that violates the basic rights of the community, namely in the form of social and economic rights of Ihe community. Therefore, the criminal act of corruption is also referred to as an extraordinary crime, in which the handling is also extraordinary (extraordinary measures). So that in this thesis there are two formulations of the problem that will be studied, namely first the conditions for granting parole to convicts of Corruption Crimes, and secondly the arrangements for granting parole to convicts of Corruption Crimes. The research method used in this thesis is normative legal research method.
