Abstract

Toulene dapat digolongkan sebagai prekursor atau bahan baku produksi narkotika pasal 129 Undang Undang Narkotika. Temuan penelitian ini menunjukkan bahwa pengetahuan teknis tingkat lanjut menciptakan beberapa pilihan, termasuk masuknya berbagai senyawa adiktif ke Indonesia. Zat-zat ini memiliki efek yang mirip dengan obat-obatan dan dapat merugikan tubuh jika digunakan secara tidak tepat. Oleh karena itu, penting untuk menegakkan pembatasan khusus bagi mereka yang kecanduan zat-zat yang tidak terdaftar dalam UndangUndang No.35 Tahun 2009. Belum adanya peraturan perundang-undangan menjadi landasan penelitian ini yang bertujuan untuk mengetahui dan menganalisis ketentuan hukum yang mengatur penggunaan obat-obatan terlarang yang tidak termasuk dalam Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika.Pengaturan senyawa zat adiktif toulene yang tidak spesifik diatur dalam udang undang narkotika, memunculkan kekosongan hukum. karena hak rehabilitasi yang seharusnya didapatkan oleh setiap warga negara indonesia sesuai dengan pasal 28 ayat 1 Undang Undang Dasar NRI 1945 yang menyatakan bahwa setiap orang berhak diakui serta mendapatkan jaminan perlindungan hukum yang sama di mata hukum, tidak bisa didapatkan dengan mudah karena senyawa toulene tidak masuk ke dalam penggolongan jenis narkotika dalam undang undang nomor 35 tahun 2009 .
