Abstract

Mekanisme dalam Perdagangan Berjangka Komoditi sangat kompleks karena terdapat kemungkinan terjadinya potensi keuntungan dan risiko kerugian yang tergolong sangat tinggi. Tingginya risiko dalam bidang ini yang mewajibkan setiap Nasabah untuk mempelajari dan memahami seluruh dokumen perjanjian sebelum melakukan transaksi melalui Pialang Berjangka. Tujuan penelitan ini adalah untuk menganalisis hubungan hukum antara Wakil Pialang Berjangka dengan Pialang Berjangka dan Nasabah di bidang perdagangan berjangka komoditi, serta pertanggungjawaban Wakil Pialang Berjangka terhadap Nasabah di bidang perdagangan berjangka komoditi. Jenis penelitian normatif dengan pendekatan perundang-undangan dan konseptual yang bahan hukumnya diambil dari peraturan Perdagangan Berjangka Komoditi yang berlaku. Hasil penelitian menyimpulkan bahwa hubungan Wakil Pialang Berjangka dengan Pialang Berjangka adalah hubungan antara majikan dengan pekerja, yang mana Wakil Pialang Berjangka mewakili kepentingan Pialang Berjangka dalam berhubungan dengan Nasabah. Apabila Wakil Pialang Berjangka dalam melaksanakan tugasnya melakukan kesalahan, maka Pialang Berjangka juga bertanggungjawab atas perbuatan tersebut berdasarkan prinsip vicarious liability, kecuali kesalahan tersebut dilakukan di luar dari pelaksanaan tugas maka pertanggungjawabannya secara personal. Atas kesalahan tersebut, Bappebti dapat menjatuhkan sanksi secara administratif atau pidana.
