Abstract

The mechanism of Commodity Futures Trading is highly complex due to the potential for significant profits and high risk of losses. The high risks involved in this field necessitate that every Client learn and understand all the contractual documents before engaging in transactions through a Futures Broker. The purpose of this research is to analyze the legal relationship between the Futures Broker Representative, Futures Broker, and Clients in the field of commodity futures trading, as well as the responsibilities of the Futures Broker Representative towards the Clients in commodity futures trading. This is a normative research study employing a legislative and conceptual approach, with legal materials drawn from the applicable Commodity Futures Trading regulations. The research concludes that the relationship between the Futures Broker Representative and the Futures Broker is akin to that of an employer and employee, where the Futures Broker Representative represents the interests of the Futures Broker in dealings with Clients. If the Futures Broker Representative makes an error in the performance of their duties, the Futures Broker is also held liable for such actions based on the principle of vicarious liability, unless the error is committed outside the scope of their duties, in which case the liability is personal. In response to such errors, the Commodities Futures Trading Regulatory Agency (Bappebti) may impose administrative or criminal sanctions.
