Abstract

Dokter spesialis anestesiologi dan terapi intensif seringkali menghadapi situasi yang membutuhkan tindakan medis berisiko tinggi pada kasus kegawatdaruratan medis. Akan tetapi, kebanyakan pasien tidak dapat memberikan persetujuan tindakan medis karena mereka dalam kondisi penurunan kesadaran. Pasal 293 ayat (5) Undang-Undang Nomor 17 tahun 2023 tentang Kesehatan dan Pasal 3 ayat (1) Peraturan Menteri Kesehatan Nomor 290/Menkes/Per/III/2008 tentang Persetujuan Tindakan Kedokteran menyebutkan bahwa tindakan medis berisiko tinggi harus mendapatkan persetujuan tertulis. Tujuan penelitian untuk menganalisis pengaturan dan perlindungan hukum dokter spesialis anestesiologi dan terapi intensif dalam hal tindakan medis berisiko tinggi pada kegawatdaruratan medis. Dengan pendekatan perundang-undangan, pendekatan konseptual, pendekatan kasus dan pendekatan historis, maka dalam penelitian ini disimpulkan bahwa terdapat beragam peraturan yang berhubungan dengan praktik dokter spesialis anestesiologi dan terapi intensif dalam hal tindakan medis berisiko tinggi pada kegawatdaruratan medis, yaitu UU Nomor 29 Tahun 2004 tentang Praktik Kedokteran, UU Nomor 36 Tahun 2009 tentang Kesehatan, dan UU Nomor 44 Tahun 2009 tentang Rumah Sakit yang digantikan dengan UU Nomor 17 Tahun 2023 tentang Kesehatan, Peraturan Menteri Kesehatan Nomor 290/Menkes/Per/2008 tentang Persetujuan Tindakan Kedokteran, Peraturan Menteri Kesehatan Nomor 519/Menkes/Per/2011 tentang Pedoman Penyelenggaraan Pelayanan Anestesiologi dan Terapi Intensif di Rumah Sakit, Peraturan Menteri Kesehatan Nomor 19 Tahun 2016 tentang Sistem Penanggulangan Gawat Darurat Terpadu dan Peraturan Menteri Kesehatan Nomor 47 Tahun 2018 tentang Pelayanan Kegawatdaruratan. Berbagai produk hukum tersebut guna perlindungan hukum dokter, memberikan pedoman tindakan yang jelas berfokus pada penyelamatan nyawa dan penerapan etika kedokteran.
